A lot of research has been done by Marlene Trestman into the history of women advocates at the Supreme Court. A good starting point is this Supreme Court Historical Society article, “Trestman’s Quest to Honor Women Advocates”, which also links to this New York Times article, “Bessie Margolin, Lawyer Who Turned Workers’ Hopes Into Law”.
More recently, Marlene published an article, “Women Advocates Before the Supreme Court”, that included a Google Docs spreadsheet named Women Advocates Through OT 24, which we have preserved here.
In an effort to root out any mistakes and omissions, and to start the process of including all women who have argued since the spreadsheet was last updated, we created a script named Audit_Women that compares all spreadsheet data to other available data and reports any discrepancies. The process involved running the script, tracking down the reason for each discrepancy, correcting transcript and/or spreadsheet data as needed, re-running Audit_Women, and repeating that process hundreds of times until all the warnings were eliminated.
As part of that process, we have produced an updated copy of Marlene’s spreadsheet named Women Advocates Through October Term 2024. That spreadsheet is no longer being used by this project as part of our Update_Advocates process, but we felt it was important to return the favor and share all our findings back. All 85 changes are also documented below.
This project doesn’t store its data in spreadsheets; all data here is stored as a collection of related JSON files, created and updated with a set of scripts maintained on GitHub, and presented through a web interface at Argument Aloud. However, when we periodically run our Update_Advocates script, we do also generate a new spreadsheet:
which contains much of the same information as previous spreadsheets, along with any additional women we have since discovered during our updates.
P.S. When I say “we”, I’m casually referring to myself and my AI collaborator, Claude. Claude is not used to directly produce or verify any data maintained here; it is used only to help produce the tools that process the data, along with the UI to present it. We all know how fallible AI can be, but we also know that humans are not infallible either, so just as our tools here cross-check one set of data against another, Claude and I check each other’s work as well.
All corrections (fixing typos, incorrect dates/citations, etc) that we made to Women Advocates Through October Term 2024 are printed below.
It’s worth noting that Bessie Margolin argued only 23 times, despite having 24 cases attributed to her. Adding to the confusion is Earl Warren’s comment about her “27 [cases] in the Supreme Court” during his remarks at her retirement gala in January 1972. While “27 cases” may be technically correct, we are more concerned here with total arguments, not total cases, as sometimes multiple cases are consolidated for argument.
Bessie Margolin’s arguments in the following 3 cases included 4 other cases:
These consolidations reduce her total number of cases argued from 27 to 23, but the reason we end up with 24 is due to how the Court ultimately ruled in the first set of cases, writing a separate opinion for each of the consolidated cases, effectively “unconsolidating” them; see 10 East 40th Street Building, Inc. v. Callus (No. 820) and Borden Co. v. Borella (No. 688).
For the sake of argument, we believe that “unconsolidating” two cases after they were argued as one does not subsequently transform one argument into two.
